Van DeWater and Van DeWater LLP offer clients representation in matters relating to trusts and estates. We are engaged in all aspects of estate planning including the preparation of wills; trust instruments; prenuptial agreements; planning for disability, including documents used to delegate health care decisions, as well as life insurance planning; establishment of private foundations and advice with respect to their management; use of wealth transfer devices, such as family limited partnerships, limited liability companies and intra-family sales; planning for valuation and disposition of intellectual property assets; business succession planning for business owners; and all related documents. When family objectives require, we also engage in charitable planning, including the use of trusts and other devices which carry out both charitable and family objectives. We enable our clients to meet their financial and personal objectives incorporating not only income, estate and gift tax law but also corporate, probate, estate, trusts, domestic relations and securities law.
In addition, the firm is responsible for the administration of estates on a day-to-day basis from probate of a decedent’s will through the final accounting and distribution of the assets. Our services include the drafting of all court documents, preparation of the federal and state estate tax returns and tax planning for income received during the administration of an estate. We have had many years of experience in handling assets which are difficult to value and in dealing with the tax authorities in estate tax audits, both on the agent and appellate levels. We also advise trustees regarding the proper administration of trusts and beneficiaries with respect to their rights in such entities. Routine administrative and tax preparation tasks are handled by our paralegal staff under the supervision of attorneys.
Because of the firm's extensive knowledge and experience in this area of law, we lecture regularly to investment advisors and financial planners.
