Real estate tax certiorari is the legal process by which a property owner can challenge the real estate tax assessment on a given property to attempt to reduce the property’s assessment, and as a result, its real estate taxes.

Van DeWater and Van DeWater LLP has extensively represented both high profile commercial clients and individual residents in real estate tax certiorari and exemption matters.

Our litigators have successfully defended actions ranging from the main IBM plant in Poughkeepsie to the South Hills Mall. We have also had positive results for a variety of other commercial clients including apartment complexes, nursing homes, office buildings, motels, mobile home parks, as well as light and heavy manufacturing plants.

We have litigated many exemption cases and condemnation proceedings. In addition, we have been involved in equalization rate protests with the New York State Office of Real Property Services (ORPS), whose mission is to lead the State's efforts to support local governments in their pursuit of real property tax equity.

The firm also prides itself in working closely with town assessors and boards of assessment review.
